SIA A (PVN) купила товар в Литве UAB B (VAT). Затем SIA A продала товар в Украину.
Товар Украина своим транспортом сразу забрала со склада в Литве. Обычно проблем нет, есть экспортная декларация и импортная
Но в этот раз Литва UAB B ставит литовский VAT и пишет аргументацию
ES directyve chapert 6 artical 146 we can sell goods with „0“ VAT which are transported outside the Community only when we (seller), or Yours company (you pay for transportation costs) are trasported goods outside Community. When i asked our projeck manager who pay for transportation -answer was - company from Ukrain. So in this case first sell UAB B Lithuania- SIA A is as sell in Lithuania (domestical) with 21 % VAT, and another SIA A – Company in UA is with “ 0” % VAT as outside the Community border.
В первый раз сталкиваюсь, что важно кто оплачивает транспортников, а не сам факт, что товар покинул ЕС

Article 146
1. Member States shall exempt the following transactions:
(a) the supply of goods dispatched or transported to a destination outside the Community by or on behalf of the vendor;
(b) he supply of goods dispatched or transported to a destination outside the Community by or on behalf of a customer not established within their respective territory, with the exception of goods transported by the customer himself for the equipping, fuelling and provisioning of pleasure boats and private aircraft or any other means of transport for private use;
На практике, Европейские поставщики требовали экспортную декларацию (иногда ее сами и открывали), убеждался что товар покинул ЕС и выставлял Invoice с 0% VAT. Логисты они такие, отвезут на склад, затаможат где им удобно итд.) Кто заказывает транспорт и кто оплачивает это вообще бред, какая разница
Как мне аргументировать правильно, что литовцы не должны выставлять свой VAT, вот в чем вопрос
Творческие бралюкай. Видимо недоимка PVM у них, вот и выкручиваются таким образом. Той же регулой и аргументировать. ИМХО
